Ford Medtech, LLC (“Company,” we,” or our”) warrants its medical device products (“Products”) in accordance with the terms set forth below.

 

This Warranty Policy applies to all Products purchased directly from the Company or its authorized sales channels.

 

1.   Limited Product Warranty

The Company warrants that its Products:

 

·         Conform to their labeled specifications at the time of delivery

·         Are free from defects in materials and workmanship under normal use and conditions This limited warranty is valid for a period of:

Warranty Period

The device will be free from defect until the expiration date.

 

2.   Scope of Warranty

This warranty applies only when:

 

·         The Product is used in accordance with:

o    Instructions for Use (IFU)

o    Product labeling
o    Applicable clinical standards

·         The Product has not been:

o    Modified, altered, or tampered with

o    Subjected to misuse, abuse, or improper handling

o    Used outside its intended purpose

 

3.   Remedies

If a Product is determined by the Company to be defective and covered under this warranty, the Company will, at its sole discretion:

 

·         Replace the Product, or

·         Issue a refund for the purchase price

This shall be the Customer’s sole and exclusive remedy under this warranty.

 

4.   Warranty Claim Process

To submit a warranty claim, Customer must:

 

·         Notify the Company within the Warranty Period

·         Provide:

o    Proof of purchase

o    Description of the issue

o    Supporting documentation (e.g., photos, batch/lot number)

The Company may require return of the Product for inspection prior to issuing a remedy.

 

5.   Exclusions

This warranty does not apply to:

 

·         Products that have been used outside their intended clinical use

·         Damage caused by improper storage, handling, or environmental conditions

·         Normal wear and tear

·         Cosmetic damage that does not affect functionality

·         Products not purchased directly from the Company or authorized channels

·         Products used after expiration (if applicable)

 

6.   Regulatory and Clinical Considerations

As a medical device manufacturer:


·         The Company does not warrant clinical outcomes or patient-specific results

·         The Product is intended for use by trained healthcare professionals

·         Clinical judgment remains the responsibility of the user

 

7.   Disclaimer of Additional Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

 

EXCEPT AS EXPRESSLY SET FORTH HEREIN, THE COMPANY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING:

·         MERCHANTABILITY

·         FITNESS FOR A PARTICULAR PURPOSE

·         NON-INFRINGEMENT

 

8.   Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

 

·         THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

·         THE COMPANY’S TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT GIVING RISE TO THE CLAIM

 

9.   Institutional / B2B Purchasers

For hospitals, health systems, and bulk purchasers:

 

·         Additional or modified warranty terms may be specified in separate agreements

·         In the event of a conflict, the applicable written agreement shall govern

·      Advance replacement may be provided for verified defective products for institutional customers

 

10.   Relationship to Return Policy

This Warranty Policy operates independently of the Company’s Return & Refund Policy.


·         Returns for unused products are governed by the Return Policy

·         Defective product claims are governed by this Warranty Policy
